1. GIVING A RECORDED STATEMENT TO AN INSURANCE ADJUSTER
Claims adjusters are trained to ask innocent sounding questions which, in reality, are questions attempting to get you to say something which may be incriminating. Once you tell them you have an attorney, they can no longer speak with you. Therefore, many of these adjusters attempt to speak with you as soon as possible after the accident, before you have retained an attorney. You are NEVER obligated to speak with an insurance adjuster!
2. TRUSTING THE INSURANCE ADJUSTER
Just remember, an insurance adjuster is not your friend. You are not “in good hands” by trusting what they tell you. They work for a corporation. Not for you. Their job is to maximize the profits of their corporation. They do this by paying you less on your claim.
3. SETTLING YOUR CLAIM FOR INSURANCE POLICY LIMITS
Even if the insurance company agrees to pay you the entire “policy limits”, this does not mean you should sign a “Release”. Your claim may be against a driver of the vehicle, but there may also be an owner that you are not aware of, who has responsibility under the Owners Liability Statue. There may be an “Umbrella Policy” that you’ve not been informed of. There may also be coverage under your own policy, called Underinsured Motorists Coverage. Never sign a release without consulting a lawyer.
4. HIRING THE WRONG LAWYER
